In the case of camera failure, inclement weather, or any other unforeseen incident that prevents HB Photography from shooting on a scheduled date the client will get a full refund of their deposit if applicable. No refund will be given under any circumstances if you fail to attend the activity on the day and at the time listed, when the booking was made.
Due to the nature of digital photography and the fact that photographs, once sent, cannot be returned; HB Photography has a strict NO REFUNDS POLICY. Once a transaction has been completed (i.e., the buyer selected and paid for the photo and then HB Photography sent the buyer the correct photograph) it is then considered non-refundable. If a buyer has selected and purchased an incorrect photo, he/she must notify HB Photography, before receiving the “incorrect” photograph. Refunds will NOT be given due to “not liking a photo”, selecting an incorrect photo after the buyer has already received the photograph, or any other reason. If a mistaken photo is sent to the buyer, as documented on the invoice, HB Photography will send the correct photo to the buyer free of charge.

Digital Print Release
The bearer of this notice has bought high resolution digital files from his or her photography session with HB Photography. Bearer is hereby granted permission by HB Photography to reproduce the images and make an unlimited number of prints, for personal use only. This permission applies worldwide.
Bearer agrees that he or she may not use any HB Photography images for commercial or editorial purposes, or enter any HB Photography images into competition without the express written permission of HB Photography. HB Photography retains the copyright to all images, per USC Title 17 (US Copyright Law).
Copyright and Licensing Notice
The images that are being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature.
Your purchase of the original files releases HB Photography from any liability due to loss or damage of the images, also releases HB Photography from any obligation to maintain copies of any digital file, image, or photograph. You hereby grant to HB Photography the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, web site, display, advertisement, and editorial use. HB Photography agrees to limit the use of these images and photographs to promotional use only. HB Photography may revoke this license at any time and for any reason. FPP retains all copyrights to the images and derivative works thereof. By using any of these images, you are agreeing to the above terms
The laws of the Country of USA in Tennessee, shall govern this contract and any applicable Federal Law.
We understand all the digital files are photographs protected by US copyright law and are owned by HB Photography (Nashville), and that such may be used for display, advertising or print exhibition.
We agree to the payment schedule listed above and understand all payments apply to wedding photography. We agree that all images from these photographs will be ordered only from HB Photography unless you have purchased the image release.
Archive/Back-up: HB will do multiple back-ups for photographs including a USB archive of cleaned images, plus online gallery account stores full resolution JPG files online. HB will not be responsible for storage of photos more than 2 years past the date of the wedding due to frequent format changes in the industry as well as a propensity for hard drives to crash. Though HB shoots and edits RAW files they will be stored in JPG format.
Film/Image Files & Copyrights: All photographs produced by HB Photography are protected by Federal Copyright Law (all rights reserved) and may not be reproduced in any manner without HB Photography’s written permission. The photographer never gives up copyright ownership of the resulting images. Photographer may grant a client permission to print images indefinitely for non- commercial use as in the case of an image release buy-out in which all of the high-resolution files will be transferred to the client for an agreed fee. CLIENT grants HB Photography (Nashville) permission to display selected images resulting from this assignment for promotion of HB Photography and release all claims to profits that may arise from use of images. Image release is for personal use only and HB Photography still requires prior notification and agreed upon reimbursement for images to be used for any commercial or editorial purposes.
Model Release: CLEINT hereby grants to HB Photography and its legal representatives the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, photography contests, online portfolio, advertising in any manner or medium. The CLIENT hereby releases HB Photography and its legal representatives from all claims and liability relating to said photographs.
Processing/Editing/Photo Manipulation: HB uses her own judgment to make alterations and adjustments to images before publication. Client hereby releases HB Photography from any liability by virtue of blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise that may occur or be produced in the taking of photographs or in any subsequent processing of the images.
Limit of Liability: In the unlikely event that the photographer is injured or becomes too ill to photograph the event, HB will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. HB Photography takes the utmost care with respect to exposure, transportation, and processing the photographs, however, in the unlikely event that photographs are lost, stolen, or destroyed for reasons within or beyond HB Photography’s control, HB Photography liability is limited to the return of all payments received for the event package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
Down payment / Retainer: In the event of cancellation, “payments made before The Event date shall be defined as “Retainer(s)” and are non-refundable upon cancellation of The Event, but may be re-applied subject to availability if The Event is rescheduled more than 120 days before the original date. It is unlikely that HB will be able to re-book the previously held date within less than 4 months out. Canceled Events must be rescheduled within 30 days of notice of cancellation in order to re-apply retainer(s). If The Event is cancelled, The Client must notify The Photographer(s) in writing that The Event has been cancelled. Rescheduled events shall be subject to standard pricing in effect on the date to which the event has been rescheduled, and any pricing changes shall be documented in a separate addendum. Additional coverage, not included herein, will be billed separately at the time of purchase. Any discounts will be applied at the time of purchase. ”
Completion Schedule: Photographer will deliver processed images through the online gallery site to client within 2-12 weeks of photography event/session. Albums designs will be completed within 120 days after client delivers their list of preferred images or notifies the photographer that they have created a proof-site folder of favorites for the album.
Shootproof Online Gallery: Is used as the gallery site when the client purchases the image release upgrade. Through Shootproof the images are available for download and prints.
Digital Image File Transfer / Disk Release (+Sales Tax): According to the TN Department of Revenue; “If the digital file is transmitted to the customer via e-mail or internet download, the charges would not be subject to sales tax under current Tennessee sales tax law.” However, if the digital file or photos are transferred to the customer on a CD, DVD, USB or other tangible medium, the total sale would be subject to sales tax. Therefore, in an effort to save my clients money and facilitate a speedier image transfer HB Photography will transfer her images through “Shootproof” an account designed for wedding clients to access and download their images to any computer they like for up to a year. If a client prefers to have their images delivered on disk, HB Photography is happy to oblige but the total package price will be subject to a 9.25% sales tax.
RESERVATION: A signed agreement and reservation fee (deposit) are required to reserve the specified date and services. This fee is a non-refundable retainer but will be applied toward the total balance.

In the unlikely event that the Laurie Oakes is injured or becomes too ill, or has an extreme emergency that prevents her from photographing the event, HB Photography (Nashville) will make every effort to reschedule the event.
Entire agreement: This agreement contains the entire understanding between PHOTOGRAPHER, Laurie Oakes, and CLIENT. Additions or changes to this agreement must be made in writing and signed by both PHOTOGRAPHER and CLIENT.
